And then with google's payment, they're trying to get it switched from jury to bench trial. The money is an after thought, what they clearly don't want is a jury of Americans reviewing damning evidence (see Bernanke) which may be harder to appeal leading to structural remedy. 2/4

I think Meta may have lost its “breakup the company” antitrust trial this morning. They get to cross starting at 1:35pm but the FTC’s key expert had a strong rebuttal to all of Meta’s TikTok noise from its witnesses. Google and Apple may appreciate company in the hot seat. /1

FTC v Meta Day 1. Opening arguments for FTC laid out its case. As predicted, Meta tried to blow hole into market definition. This actually comes later in trial so not dwelling but will add some context at end. But first witness 1 was CEO Zuckerberg. Dead to rights on conduct. /1

Attended oral arguments in NYT+ v OpenAI/Microsoft this morning @ SDNY. It was good to finally hear some back and forth - majority of claims imho will clearly survive OpenAI's attempts to dismiss - but all of OpenAI's PR offensive and talking points were on full display. /1
